These Terms of Service ("Terms") form a contract between you and Consigio ("Consigio", "we", "us", "our") regarding your use of the Consigio mobile application, website, and related services (collectively, the "Service"). The Service is a business-management platform that helps merchants operate and message their customers — including by connecting the merchant's own WhatsApp Business Account and sending messages on their behalf through the official WhatsApp Business Cloud API.
By creating a Consigio account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. These Terms work alongside our Privacy Policy and our User Data Deletion page, which explain how we handle your information.
Consigio is a product operated by Vipanshu Singh ("Consigio", "we", "us", "our"), an individual developer. The Service is provided from India. You can contact us at support@consigio.com.
To use the Service you must be at least 18 years old and legally able to form a binding contract. The Service is a business tool intended for merchants and other businesses; it is not directed to consumers acting outside a business context.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information (such as your name, email address, and business details) and keep it up to date. Notify us promptly at support@consigio.com if you believe your account has been compromised.
By using the Service, you agree to:
Certain features require a paid subscription ("Consigio Pro"). Subscriptions are processed through our payments provider, RevenueCat, and the applicable app store (Apple App Store or Google Play).
To send and receive messages, the Service integrates with the WhatsApp Business Cloud API operated by Meta Platforms, Inc. When you connect your account:
Other third parties — such as our hosting/database provider (Supabase) and our payments provider (RevenueCat) — process data on our behalf as described in our Privacy Policy. We are not responsible for the independent practices of third parties once data has been transmitted to them in accordance with these Terms and our Privacy Policy.
"Your Content" means the data you create, import, submit, or send using the Service — including your business profile, customer contact records, message templates, and the messages you send and receive.
The Service, including its software, design, text, trademarks, and branding, is owned by Consigio or its licensors and is protected by law. We grant you a personal, non-transferable, non-exclusive license to use the Service for its intended business purpose while you comply with these Terms.
You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works of the Service or its software, except as expressly permitted. "Consigio" and related marks are trademarks of Consigio; you may not use them without permission.
You may stop using the Service at any time and delete your account from the in-app settings. We may suspend or terminate your access, or remove content, if you materially or repeatedly breach these Terms, if required by law or a third-party platform (such as Meta), or if your use creates risk or harm to Consigio, our users, or others. Where reasonable, we will try to give notice and an opportunity to address the issue before taking action.
Upon termination, your right to use the Service ends. Sections of these Terms that by their nature should survive (such as IP, disclaimers, limitation of liability, and governing law) will survive.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that messages will always be delivered (delivery depends on Meta, carriers, and recipient devices).
The Service is not a substitute for professional legal, tax, or financial advice. Message deliverability, compliance, and your customers' responses depend on factors outside our control.
To the extent permitted by law, Consigio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising from your use of or inability to use the Service. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred US dollars (US$100).
Nothing in these Terms excludes or limits liability that cannot be limited under applicable law, such as for fraud, death, or personal injury caused by negligence.
These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. You and Consigio agree to submit to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India for any dispute arising out of or relating to these Terms or the Service.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide more prominent notice (such as in-app or by email). By continuing to use the Service after changes take effect, you agree to the updated Terms. If you do not agree, you should stop using the Service.
